1. SHIPPING AND DELIVERY
In order to always offer our
best price, many products are shipped directly from the manufacturer's
warehouse, avoiding unnecessary intermediate steps. For this reason, the
collection of the goods at the point of sale is a possibility to be agreed in
advance.
Most items are shipped within three business days. However, some objects, such
as leavening cells, some trolleys and other products assembled on request, have
variable average processing times, which it will be possible to know when
ordering.
Any external damages must be immediately reported to the courier making the
delivery. In any case, it is advisable to affix the word "I accept with
reserve of control" on the accompanying document specifying the anomaly
found.
In the event of an agreed collection, the costs and care of the transport are
to be considered at the expense of the buyer. The buyer, or third parties
appointed by him to carry out the collection, are required to check the state
of the packaging at the time of collection, reporting any anomalies.
Some products (e.g. trolleys, etc.) may be shipped in an assembly box and not
as in the image, for illustrative purposes.
Delivery to the floor is not foreseen.
The prices of products and shipments do not include customs duties, unless
expressly indicated. International shipments have variable costs per country;
therefore, a personalized quote is required for each international shipment.
1.1 Express courier:
Transportation in Italy
takes 1-3 working days, from Monday to Friday *.
Absent recipient: in case of non-delivery for absent recipient, the courier
will leave a delivery attempt notice: the recipient is given the right to
request delivery from the carrier within 3 days following the first attempt;
after three days without communication by the recipient, the delivery will be
considered canceled. The recipient can contact Foodandrent s.r.l. to the email
address info@foodandrent.com to request the return of the product, again paying
the cost.
1.2 Specialized courier:
Transportation in Italy takes
on average 3 to 5 working days, except for remote or disadvantaged
destinations.
In the case of non-delivery for absent recipient, the object will be retained
in storage at the place of jurisdiction. The recipient can contact Foodandrent
s.r.l. to the email address info@foodandrent.com to request the return of the
product, bearing the cost of the second delivery attempt.
• Optional for shipments: optional services are offered that can be selected
when placing the order
• Delivery notice: at the discretion of the courier, by phone or SMS
• Extra Insurance: to compensate for any damage caused by transport. It
guarantees the restoration or replacement of the damaged goods. Where not
possible, the refund can be evaluated. In the absence of Extra Insurance, the
goods travel with basic insurance for which a refund of 1 € / kg is provided.
• Hydraulic lift: for unloading heavy and / or bulky goods (eg refrigerators).
In the absence of a lift request, the transporter will not be able to unload
the goods independently.
* The delivery forecasts are indicative and are based on statistical surveys
that show a reliability generally higher than 90%. In general, there is no
essential delivery term for shipments and any compensation for delays in
delivery forecasts is excluded. Delivery times are declared by the carriers,
therefore any delays cannot be attributed to Foodandrent s.r.l ..
2. PRODUCT NOT CONFORMING OR DEFECTIVE
In the event of a product not conforming to the description or defective, for
purchases by private consumers, it is possible to evaluate the free replacement
within 8 days of delivery: the product, with the complete and complete
packaging (including any accessories), must be returned to Foodandrent s.r.l.
which then will ship a replacement product with the same or similar
characteristics.
The shipping costs of the replacement product will be borne by Foodandrent
s.r.l., while the cost of returning the defective product will be borne by the
buyer.
If the replacement is not possible, it will be possible to arrange a refund of
the amount paid for the purchase.
The products may have aesthetic differences from the published images (e.g.
colors, labels etc.). Any differences, however, will not be such as to change
the functionality of the product.
3. RIGHT OF WITHDRAWAL
Sales of products via the Internet are governed by articles 45 to 67 of
Legislative Decree 206/2005 (Consumer Code). This legislation provides the
Community consumer with the right to withdraw from contracts or contractual
proposals, guaranteeing him the right to return the purchased product and to be
reimbursed for the expenses incurred. The right of withdrawal does not apply to
sealed audiovisual products and IT software products opened by the consumer,
nor to sealed goods that do not lend themselves to be returned for hygiene or
health protection reasons that have been opened after delivery. The right of
withdrawal applies to the product purchased in its entirety; it is not possible
to exercise withdrawal only on part of the product. In accordance with the
provisions of article 59, lett. c) and d) of the Consumer Code, the Consumer
Customer cannot exercise the right of withdrawal for Products made to measure
or clearly personalized or which risk deteriorating or altering rapidly.
The Customer is responsible for the decrease in the value of the goods
resulting from a manipulation other than that necessary to establish the
nature, characteristics and functioning of the products, namely:
• the compromise of the integrity of the asset due to non-diligent use or the
use of any consumables;
• in the absence of the original packaging;
• in the absence of integral elements of the product (accessories, cables,
instruction manuals, etc).
3.1 Exclusions:
the right of withdrawal is
reserved exclusively to consumers (natural persons who purchase goods not for
purposes related to their professional, commercial or entrepreneurial
activity), therefore it cannot be exercised by legal persons and natural
persons who act for referable purposes any professional activity.
The return of the product is to be intended at the expense and care of the
customer.
3.2 Methods and times for exercising the right of withdrawal:
the Customer has a period of
14 (fourteen) days to withdraw. The withdrawal period ends after 14 (fourteen)
days from receipt of the goods or, in the case of services, from the conclusion
of the contract. Within this period, the customer must communicate to
Foodandrent s.r.l. the willingness to withdraw from the contract by sending a
registered letter with acknowledgment of receipt - preceded by a communication
by e-mail to foodandrentsas@pec.it - using the form available on our site in
the returns section (found in the home below), or any other explicit
communication of the decision to withdraw, indicating the order number, code
and quantity of the items, if the withdrawal is partial (only in the case of
purchase of multiple items) or total and the bank details to obtain the bank
transfer of refund (Iban code of the order holder) to the following address:

Within 14 (fourteen) working days of the communication, the Customer will, at
his own expense, send the properly packaged product, accurately indicating the
Customer data declared at the time of the order at the same address. The
shipment for the return of the material, up to the verification by Foodandrent
s.r.l., is under the complete responsibility of the Customer. In case of damage
in the transport for the return, Foodandrent s.r.l. will promptly notify the
event, to allow you to file a complaint against the chosen courier and obtain a
refund of the value of the asset (if insured); in this case, the product will
be made available to the customer for collection and at the same time will
invalidate the request for withdrawal and therefore refund.
Foodandrent s.r.l. will not be able to respond in any way for damage, theft /
loss during the transport phase of the goods returned by the Customer.
3.3 Methods and times for reimbursement to the Customer:
pursuant to article 56 of
Legislative Decree 206/05 Foodandrent s.r.l. will reimburse all payments within
14 (fourteen) days from the date on which it became aware of the exercise of
the right of withdrawal by the Customer, including delivery costs (with the
exception of additional costs deriving from the possible choice of services
accessories or a type of delivery other than the less expensive type of
standard delivery offered by Foodandrent srl).
Foodandrent s.r.l. you can keep the refund until you have received the intact
product.
4. WRONG PURCHASE
Generally speaking, there is no substitution in case of purchase of wrong
product by companies and other legal entities. Foodandrent s.r.l. however, it
reserves the right to derogate with discretionally granted exceptions,
communicating methods and any costs. However, the return of the product to be
replaced is always intended at the customer's expense. Maximum attention is
recommended in the protection of goods: it will not be possible to accept the
return of damaged or incomplete products, and / or with damaged or incomplete
packaging.
5. PAYMENTS
Payment must be made within 7 days of purchase. After this term, Foodandrent
s.r.l. will have the right to deem the order null.

Credit card: the most common credit cards are accepted, also prepaid and
rechargeable: Visa, MasterCard. With the payment by credit card will not be
charged any type of supplement. Orders made by credit card, before being
processed, can be subjected to authenticity checks directly by the relative
institutes. These checks may take an average of 24 hours, to be added if
necessary to the processing times.
Foodandrent s.r.l. reserves the right to request additional information from
the Customer such as a landline number or sending a copy of documents proving
ownership of the Card used. In the absence of the required documentation,
Foodandrent s.r.l. reserves the right to cancel the order.
Bank transfer: choosing this method of payment, once the order has been placed,
it is necessary to follow the procedure below:
• make the bank transfer within 5 working days of placing the order (under
penalty of canceling the order itself);
• the reason to be reported on the bank transfer must indicate: the number and
date of the order, the name and surname of the originator / Company name;

Banking practice requires that the transfer be credited to the beneficiary's
current account no earlier than 1-2 working days from its execution. The order
will be handled upon receipt of the reclaimed amount, therefore the above
banking times must be added to the normal delivery times.
Cash on delivery (available for some products):
By choosing cash on delivery, the buyer can make the payment upon receipt of
the product. Payment can only be made by credit / debit card (no checks, no
cash).
6. GUARANTEES:
notwithstanding the
guarantee pursuant to art. 1490 et seq., The products purchased by subjects
other than private consumers (natural persons who purchase the goods not for
purposes related to their professional, commercial or entrepreneurial
activity), or legal persons and natural persons who act for purposes related to
the professional activity, if any, have a 12 month commercial guarantee. For
products of the Professional Line, in the event of a lack of conformity, during
the commercial warranty period (12 months), the seller undertakes to provide
free of charge the spare parts necessary to restore conformity of the product
or to repair the factory, after shipment by the customer, of the item at the store.
In any case, damage caused by incorrect use of the item is not covered by the
warranty.
ATTENTION: the products marked with the word "CE home" do not have
the necessary certifications for professional use; therefore they are not
salable and billable to companies.
7. PERFECTION OF THE ORDER
The placing of orders constitutes an irrevocable proposal by the buyer,
pursuant to art. 1329 of the Civil Code, to be considered in any case subject
to acceptance by the company Foodandrent s.r.l. Any refusal of the proposal
will be communicated in writing, and will result in the return of any advance
payments and security deposits, which in any case do not constitute a
commitment to accept the order. In the event of cancellation of the order due
to the request and / or responsibility of the buyer, Foodandrent s.r.l. will
have the right to withhold the advances paid by the latter as a penalty except
for compensation for the greater damage. Any changes or exceptions to the
conditions indicated in this proposal will be valid only if agreed and accepted
in writing.
8. JURISDICTION
For any controversy the Court of Catania will be exclusively competent. In the
case of a contract stipulated by the Consumer, the Court of domicile or
residence of the Customer will be competent.
The buyer is responsible for the correctness, completeness and truthfulness of
the personal or business data provided at the time of registration of the
purchase order, as well as the completeness and correctness of the data
relating to the e-mail address.
